These General Terms and Conditions (GTC) apply to all deliveries of Seewald Antikschmuck to consumers (§ 13 BGB).

3.1 ) The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to order. Errors excepted.

3.2 ) By clicking the button "Order with payment" in the last step of the ordering process, you place a binding order for the goods listed in the shopping cart. The purchase contract is concluded when we accept your order by sending an order confirmation by email immediately after receiving your order.

3.3 ) You have the option of concluding the purchase contract in German or English.

Right of withdrawal

You have the right to withdraw from this contract within thirty days without giving any reason. The withdrawal period shall be thirty days from the day on which you or a third party other than the carrier designated by you takes possession of the goods.

by means of a clear statement (e.g. a letter sent by post or e-mail) of your decision to withdraw from this contract.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the expiry of this period.

The exchange or return of jewelry is not possible if individual changes have been made after purchase according to the buyer's wishes. In most cases, this concerns the adjustment of ring sizes.

On 21 October 2020, the ECJ ruled (C-529/19) that even if the entrepreneur has not yet started manufacturing the goods at the time of withdrawal, the statutory exclusion of the right of withdrawal for goods that are manufactured according to the customer's specifications or are clearly tailored to his personal needs continues to apply.

Consequences of revocation

If you cancel this contract, we will reimburse you all payments made by you, including the costs of delivery, less any additional costs for a type of delivery other than our standard delivery. This reimbursement will be made immediately after we have received the goods back.

The refund will be made using the same means of payment as you originally used, unless expressly agreed otherwise. There will be no fees for this refund.

The products must be returned or handed over to Seewald Antikschmuck, Elisabethstraße 4, 25980 Westerland / Sylt, promptly and at the latest within fourteen days from the date on which you notify us that you have cancelled this contract. This deadline is deemed to have been met if you send the products before the expiry of fourteen days. You will bear the direct cost of returning the goods.

You are only liable for any loss of value of the goods if this is due to handling of the goods which was not necessary to check their quality, properties and functioning.

5.1 ) The prices stated on the product pages are final prices. Differential taxation according to § 25a UStG applies.

Our shipping is mandatorily insured and identified. It is free worldwide.

We attach great importance to the safe and timely delivery of our packages. This includes the voluntary booking of the paid option for personal delivery with signature. According to this binding agreement between the shipping service providers, a package is considered delivered as soon as the required signature has been provided. If a package is lost despite a delivery receipt, this is considered theft by the recipient. The recipient is obliged to report this theft to the shipping service provider and the police. We, Seewald Antikschmuck Sylt, as the sender will provide full support in resolving any problems.

Deliveries to countries outside the EU may incur additional taxes or duties such as customs duties which are not covered or charged by us. These costs must be paid directly to the relevant customs or tax authorities. Please check with the relevant authorities for details.

7.1 )Payment can be made by payment on site or advance transfer:

Immediate transfer, credit card, purchase on account (Klarna) or via PayPal to the Seewald Antikschmuck company account.

7.2 ) The bank details will be provided by Seewald Antikschmuck in the order confirmation. The goods will be delivered after receipt of payment or credit to the account.

7.3 ) Seewald Antikschmuck reserves the right to refuse shipment of particularly sensitive goods and to request the buyer to collect the goods personally.

7.4 ) A right of set-off only exists if your counterclaims have been legally established by a court, are undisputed or have been acknowledged by us in writing.

7.5 ) A right of retention can only be exercised if the claims result from the same contractual relationship.

The goods remain our property until full payment has been made. We will not dispatch any goods until full payment has been received or a corresponding credit has been made to our account.

The warranty is provided in accordance with statutory provisions. For all defects that occur during the statutory warranty period of one year from delivery, you have the statutory right to subsequent performance (at your discretion: remedy of the defect or delivery of an equivalent piece of jewelry) and - if the statutory requirements are met - the statutory rights to reduction or withdrawal as well as compensation for damages.

10.1 ) The sole place of jurisdiction for all disputes is Westerland/Sylt.

10.2 ) German law applies.

10.3 ) Should individual provisions of these General Terms and Conditions be or become invalid or void, the validity of the remaining provisions shall remain unaffected. Otherwise, the statutory provisions shall apply.
