1. Scope of Application
These General Terms and Conditions apply to orders placed through the online shop of Saskia Seewald Antikschmuck.
A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.
An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity.

3. Products and Condition of Antique Jewellery
The jewellery offered consists predominantly of antique, historical, or previously used unique pieces.
Signs of age and wear, historical manufacturing techniques, as well as other properties expressly described in the respective offer and recognizable in the product images, belong to the agreed condition of the jewellery.
Statutory warranty rights for defects not described or not agreed upon remain unaffected.
Due to the uniqueness of the jewellery offered, a replacement delivery with an identical piece of jewellery is generally not possible. The statutory provisions for supplementary performance remain unaffected.
4. Offer and Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer to conclude a purchase contract, but rather an invitation to place an order.
You can initially place the desired products in the shopping cart without obligation. Before submitting the order, you can review your entries at any time and correct them using the correction options provided in the ordering process.
By clicking the final order button, clearly marked as requiring payment, you submit a binding offer to purchase the products contained in the shopping cart.
The automatically sent confirmation of receipt of your order does not yet constitute acceptance of the offer, unless acceptance is expressly declared therein.
We can accept your offer within five days by:
- an express order or acceptance confirmation by email,
- the shipping confirmation or the dispatch of the goods, or
- a request for payment or the initiation of the payment process.
The decisive factor is the time at which one of these events occurs first. If the offer is not accepted within this period, it is deemed rejected. Payments already made will be refunded immediately in this case.
As these are mostly unique items, it may in rare cases happen that an item is sold simultaneously outside the online shop. In this case, a contract will not be concluded if we have not yet accepted the online order.
5. Contract Language, Contract Text and Correction of Input
The German and English languages are available for the conclusion of the contract.
The order data will be stored after the order has been completed and sent to you by email. Customers with a customer account can also view their orders in their customer account.
The respective applicable General Terms and Conditions can be accessed, saved and printed before placing the order.
Until the final order button is clicked, input errors can be corrected using the editing functions provided in the shop or the usual functions of the browser.
6. Prices and Taxes
The prices stated in the online shop are total prices.
If margin taxation according to § 25a of the German Value Added Tax Act is applied to a piece of jewellery, the VAT included in the price will not be shown separately.
For deliveries to countries outside the European Union, import duties, customs duties, taxes or fees may arise. These are not levied by us and are generally to be paid by the recipient to the competent authorities or service providers.
7. Payment Methods
The available payment methods are displayed in the online shop and during the ordering process.
Currently, payment can be made by bank transfer and PayPal, among others. Further payment methods may be offered depending on the destination country and the payment service providers available at checkout.
For payment by bank transfer, the invoice amount is due for payment after conclusion of the contract. The bank details will be provided with the order or payment confirmation. Shipping will take place after receipt of the full invoice amount.
When using a payment service provider, its terms of use and payment also apply. Your statutory rights against us remain unaffected.
8. Delivery and Shipping
Delivery is made to the countries that can be selected as the delivery country during the ordering process.
Shipping is free and insured.
The delivery time within Germany is usually two to five working days, unless a different delivery time is specified for the respective product.
For deliveries outside Germany, the delivery time specified in the online shop or during the ordering process for the respective destination country applies.
Working days within the meaning of this regulation are Monday to Friday, with the exception of public holidays at the seller's registered office.
For consumers, the risk of accidental loss or accidental deterioration of the goods passes to the consumer or a third party authorized by him to receive the goods only upon handover. This does not apply if the consumer has commissioned a carrier not named by us.
9. Retention of Title
The goods remain our property until full payment has been made.
10. Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal in accordance with the following cancellation policy.
The right of withdrawal can also be exercised via the electronic function "Revoke contract" linked in the footer on every page of the online shop.
11. Individual Adjustments
Upon request, individual pieces of jewellery, especially rings, can be individually adjusted after prior consultation.
Exclusion of the right of withdrawal only applies if the legal requirements for goods clearly tailored to the customer's personal needs are actually met.
A change in ring size does not automatically lead to the exclusion of the right of withdrawal in every case. If a specific adjustment is to be excluded from the statutory right of withdrawal, the customer will be informed separately before placing their order.
12. Statutory Liability for Defects
The statutory liability for defects applies.
The statutory limitation period for claims for defects by consumers is not shortened by these General Terms and Conditions.
The age-related, use-related or manufacturing-related properties of antique jewellery specifically described in the respective offer are considered as agreed condition. The statutory rights for defects that deviate from this or are not disclosed remain unaffected.

14. Consumer Dispute Resolution
We are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
15. Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the state in which they have their habitual residence.
16. Place of Jurisdiction
For consumers, the statutory places of jurisdiction apply.
If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for disputes arising from the contractual relationship is the seller's business location.

Right of Withdrawal Information
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day,
- on which you or a third party named by you, who is not the carrier, has taken possession of the goods, or
- in the case of a single order for several goods that are delivered separately, on which you or the third party named by you has taken possession of the last goods.

by means of a clear statement of your decision to withdraw from the contract. The declaration can be made, for example, by letter or email.
You can use the model withdrawal form below for this purpose. The use of the form is not mandatory.
You can also submit your withdrawal via the electronic function "Withdraw contract" linked in the footer on every page of our online shop. After sending the electronic withdrawal, you will immediately receive an electronic confirmation of receipt, which contains the content of your declaration as well as the date and time of receipt.
To comply with the withdrawal period, it is sufficient that you send your declaration of withdrawal before the expiry of the withdrawal period.
Consequences of withdrawal
If you withdraw from this contract, we will refund all payments we have received from you, including the costs of a standard delivery offered by us.
Additional costs incurred because you have chosen a delivery method other than the cheapest standard delivery offered by us will not be refunded.
The refund will be made immediately and no later than fourteen days from the day on which your declaration of withdrawal was received by us.
For the repayment, we will generally use the same means of payment that you used for the original transaction, unless something else has been expressly agreed. No fees will be charged for the repayment.
We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods. The earlier of these two dates shall apply.
You must return or hand over the goods immediately and no later than within fourteen days from the day on which you informed us of the withdrawal, to the following address:

The return deadline is met if you send the goods before the expiry of the fourteen-day period.
You bear the direct costs of returning the goods.
You only have to compensate for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary for checking their condition, properties, and functionality.
Exclusion of the right of withdrawal
The right of withdrawal does not apply, in particular, to contracts for goods that have been clearly customized according to the consumer's personal needs and that meet the legal requirements for an exclusion of the right of withdrawal.
Whether a specific ring size change or other customization falls under this depends on the scope and type of the respective customization. You will be informed separately of any applicable exclusion before placing your order.
